Terms of Service

These Terms of Service ("Terms") govern your access to and use of landmark.stream and the related services (the "Service"), operated by Landmark ("Landmark", "we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 13 to use the Service, and at least 18 to use paid features or receive payouts. You are responsible for complying with the terms of any third-party platform you connect (Twitch, YouTube, Kick, TikTok, Rumble), and you represent that your use of Landmark with those platforms does not violate their rules.

2. Private alpha

Landmark is currently offered as a private alpha. The Service is provided on an "as is" and "as available" basis: features may be incomplete, may change, may break, or may be discontinued, and we do not offer any uptime or service-level guarantee during the alpha. Access is granted by approved application or by purchasing Gold Alpha, and we may grant, limit, or revoke access at our discretion.

3. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

4. Payments, fees, and payouts

• Gold Alpha is a one-time purchase that grants alpha access and the perks described at checkout (bonus usage credits and a standing fee discount). Gold purchases are generally non-refundable except where required by law.
• Landmark Coins / top-ups and tips are processed through Stripe. Coins are credits usable within the Service and are not legal tender, redeemable for cash, or transferable except as expressly provided.
• Landmark Usage fees for metered products (such as AI Camera, AI text-to-speech, and the AI assistant) accrue as you use them and are billed on a recurring basis. Current rates are shown in the product and may change with notice.
• Payouts to streamers are made via Stripe Connect. You are responsible for the accuracy of your payout details and for all taxes on amounts you receive. On direct cash tips, payment-processing fees are deducted from the streamer's share.
• Referral / affiliate program. Eligible accounts may earn a share of qualifying Landmark Usage fees generated by accounts they refer, credited as Landmark Coins and subject to the rates and rules shown in the Referrals dashboard. Rewards are earned only on genuine, arms-length sign-ups: self-referrals, fake or duplicate accounts, and other abuse are not eligible, and we may withhold, reverse, or claw back rewards (including already-credited coins) tied to such activity or to refunded/disputed charges. We may change, suspend, or end the program, or modify reward rates, at any time with notice. If you promote your referral link to your audience, you must clearly disclose that you may receive a payout when they sign up, consistent with applicable advertising and endorsement rules.

5. Acceptable use

You agree not to:

• use the Service for unlawful, harmful, deceptive, or abusive purposes;
• violate the rules or terms of any connected platform;
• infringe others' intellectual-property or privacy rights;
• attempt to circumvent fees, access controls, rate limits, or security;
• resell or sublicense the Service without our permission; or
• interfere with or disrupt the Service or other users.

6. Your content

You retain ownership of the content you create or upload (overlays, sounds, prompts, cloned-voice samples, etc.). You grant Landmark a non-exclusive license to host, process, and display that content as needed to operate the Service for you. You are responsible for having the rights to any content you upload — including the right to create a synthetic clone of a voice you submit.

7. Third-party platforms & services

The Service integrates with third-party platforms and providers. We are not responsible for those services, their availability, or their actions, and your use of them is governed by their own terms.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (e.g. payment obligations, disclaimers, limitations of liability) will survive.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Landmark will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold Landmark harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or any third-party rights.

12. Changes to these Terms

We may update these Terms as the Service evolves. We will revise the "Last updated" date above, and material changes will be communicated where appropriate. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States and the state in which Landmark operates, without regard to conflict-of-laws rules.
